ANDROID MOBILE APPLICATION END-USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS MOBILE APPLICATION END-USER LICENSE AGREEMENT (“EULA AGREEMENT”) CAREFULLY, BEFORE COMPLETING THE DOWNLOAD OR INSTALLATION PROCESS OR USING THE APPLICATION, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND REMEDIES.

1. OVERVIEW

This EULA agreement is a binding agreement, entered into by and between Production Ready LLC, registered address 406 Sanchez Street, San Francisco, CA 94114, (“Production Ready”) and you, and is made effective as of the date you download, install or use the Application Airo Mail (“Application”) or from the date of your electronic acceptance.

This EULA agreement sets forth the general terms and conditions of your use of the Application, provides a license to use Production Ready Application and contains liability disclaimers. This EULA agreement’s terms also apply to any Application update, upgrade, internet-based service, and support service for the Application. Whether you are acquiring Application directly from Production Ready or through Production Ready authorized reseller your electronic acceptance of this EULA agreement signifies that you have read, understand, acknowledge, and agree to be bound by this EULA agreement.

The terms “we”, “us” or “our” shall refer to Production Ready. The terms “you”, “your”, or “User” shall refer to any individual or entity who accepts this EULA agreement, uses our Application, or has access to our Application.

Production Ready may, in its sole and absolute discretion, change or modify this Agreement, and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting. Your use of this Application after such changes or modifications have been made shall constitute your acceptance of this EULA agreement as last revised.

BY DOWNLOADING /INSTALLING /USING THE APPLICATION YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS EULA AGREEMENT AS LAST REVISED, DO NOT DOWNLOAD, INSTALL, USE (OR CONTINUE TO USE) OUR APPLICATION.

2. ELIGIBILITY

Our Application is available only to Users who can form legally binding contracts under the applicable law. By downloading or using this Application, you represent and warrant that you are (i) at least thirteen (13) years of age, (ii) otherwise recognized as being able to form legally binding contracts under applicable law, and (iii) are not a person barred from purchasing or using the Application under the laws of the United States, California or other applicable jurisdiction.

For Users Under 18: If you are between the ages of 13 and 17, you may only use this Application with the consent and supervision of a parent or legal guardian who agrees to be bound by this EULA agreement.

Family Policy Compliance: If you are under 13 years of age, this Application is not intended for you and you may not use it. We comply with the Children’s Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13.

If you are entering into this EULA agreement on behalf of a company or any corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms and conditions contained in this EULA agreement, in which case the terms “you”, “your”, or “User” shall refer to such corporate entity. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Application, and you must not accept this EULA agreement.

3. LICENSE GRANT

Subject to the terms of this EULA Agreement Production Ready hereby grants you a personal, revocable, worldwide, non-exclusive, non-sublicensable, and non-transferable license to use the Production Ready Application on your own devices in accordance with the terms of this EULA agreement. The Application is being licensed to you and you hereby acknowledge that no title or ownership of the Application is being transferred or assigned to you and this EULA agreement is not to be construed as a sale of any rights of the Application.

You are permitted to install and use the Production Ready Application on Android devices under your control. You are responsible for ensuring your device meets the minimum requirements of the Production Ready Application.

4. DEVICE PERMISSIONS

The Application may request certain permissions on your Android device to function properly, including but not limited to:

  • Storage Access: To save and retrieve email data and attachments
  • Network Access: To connect to email servers and sync data
  • Camera: To capture photos for email attachments (if applicable)
  • Contacts: To access your contact list for email addressing (if applicable)
  • Notifications: To display email notifications

By installing the Application, you consent to these permissions. You may revoke these permissions through your device settings, though this may limit the Application’s functionality.

5. RESTRICTIONS

Without first obtaining the express written consent of Production Ready, you may not assign your rights and obligations under this EULA agreement, or redistribute, encumber, sell, rent, lease, sublicense or in other way transfer your rights to the Application.

You are not permitted to:

  • edit, modify, alter, adapt, or otherwise change the whole or any part of the Production Ready Application nor permit the whole or any part of the Application to be combined with or become incorporated in any other Application or any software, nor decompile, disassemble or reverse engineer the Application or attempt to do any of the listed actions,
  • copy, reproduce, duplicate, resell or distribute in any medium any part of the Application, except where expressly authorized by Production Ready,
  • remove or alter Production Ready trademarks or logos or legal notices included in the Application or related assets,
  • remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting the Application,
  • use the service to try to gain unauthorized access to any service, data, account or network by any means,
  • use the Application in any way which breaches any applicable local, national or international law,
  • use the Application for any purpose that Production Ready considers is a breach of this EULA agreement,
  • use the Application to engage in any activity that could harm minors,
  • use the Application to create, distribute, or facilitate the distribution of spam or malicious content,
  • use the Application in violation of any third-party rights, including intellectual property rights,
  • sideload or distribute modified versions of the Application outside of official app stores.

Production Ready reserves the right to determine in its sole discretion what kind of conduct is considered to be in violation of the terms of this EULA agreement.

6. INTELLECTUAL PROPERTY

No part of this EULA agreement is or should be interpreted as a transfer of intellectual property rights. Production Ready shall retain ownership of the Application as originally downloaded by you and all subsequent downloads of the Application by you. The Application (and the copyright, and other intellectual property rights of whatever nature in the Application, including any modifications made thereto) are and shall remain the property of Production Ready.

Production Ready content used in this Application, including without limitation the text, scripts, source code, API, graphics, photos, sounds, music, videos, and interactive features and the trademarks, service marks, and logos contained therein, are owned by or licensed to Production Ready in perpetuity, and are subject to copyright, trademark, and/or patent protection.

Production Ready content is provided to you “as is”, “as available” and “with all faults” for your information and personal, non-commercial use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purposes whatsoever without the express prior written consent of Production Ready.

7. PRIVACY AND DATA COLLECTION

You acknowledge that when you download, install, or use the Application, Production Ready may collect and process personal information in accordance with our Privacy Policy. All information we collect through or in connection with this Application is subject to our Privacy Policy available at https://www.airo.email/policies/privacy .

Data Processing: By using this Application, you consent to the collection, processing, and storage of your personal data as described in our Privacy Policy, including but not limited to:

  • Device information and usage analytics
  • Email content processing for app functionality
  • Account information and preferences

Google Play Services: This Application may use Google Play Services, which are subject to Google’s Privacy Policy. Data collected by Google Play Services is governed by Google’s privacy practices.

Third-Party Services: This Application may integrate with third-party services for functionality. Your use of such services is subject to their respective privacy policies and terms of service.

Data Security: We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.

GDPR Compliance: If you are located in the European Union, you have additional rights under the General Data Protection Regulation, including the right to access, correct, delete, or port your personal data.

8. CONTENT AND CONDUCT POLICIES

Prohibited Content: You may not use this Application to create, transmit, or store content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or other harmful code
  • Is designed to harm, exploit, or endanger minors
  • Promotes illegal activities or violates any applicable laws
  • Violates Google Play Developer Policies

Content Moderation: Production Ready reserves the right to review, monitor, and remove any content that violates these terms or is otherwise inappropriate, at our sole discretion and without prior notice.

User Responsibility: You are solely responsible for all content you create, transmit, or store using this Application and must ensure compliance with all applicable laws and regulations.

9. UPDATES AND MODIFICATIONS

Production Ready may from time to time develop and provide Application updates, which may include upgrades, bug fixes, patches, other error corrections, and/or new features (collectively, “Updates”). Updates may also modify or delete certain features and functionality.

Updates may be delivered through Google Play Store or other mechanisms. You acknowledge that some Updates may be required for continued use of the Application.

All Updates will be deemed part of the Application and subject to all terms and conditions of this Agreement.

10. THIRD-PARTY MATERIALS

The Application may display, include, or make available third-party content or provide links to third-party websites or services (“Third-Party Materials”). You acknowledge and agree that Production Ready is not responsible for Third-Party Materials, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof.

Third-Party Materials are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

11. USER CONTENT

The Application may allow you to create content such as emails, data, photographs, messages, graphics, text, and other information (“User Content”).

User Content License: By creating User Content through the Application, you grant Production Ready a limited, non-exclusive, royalty-free license to process, transmit, and store your User Content solely as necessary to provide the Application’s functionality and services to you.

Content Ownership: You retain ownership of your User Content. Production Ready does not claim ownership over your personal emails, messages, or other content you create or store using the Application.

Content Removal: You may delete your User Content at any time through the Application’s interface. Upon deletion, Production Ready will remove your User Content from active systems within a reasonable timeframe, though backup copies may be retained for technical and legal compliance purposes.

12. GOOGLE PLAY STORE SPECIFIC TERMS

The following applies to the Application accessed through or downloaded from the Google Play Store (“Play Store Sourced Application”):

Google Play Policies: Your use of the Play Store Sourced Application must comply with Google Play’s Developer Program Policies and Google Play Terms of Service.

Google Play Billing: If the Application includes in-app purchases or subscriptions, all transactions are processed through Google Play Billing and are subject to Google Play’s payment terms.

Content Rating: This Application has been assigned a content rating in accordance with Google Play’s content rating system. Use of the Application should comply with this rating.

Google Play Services Integration: The Application may use Google Play Services for enhanced functionality, including but not limited to:

  • Authentication and account management
  • Cloud storage and backup
  • Push notifications
  • Location services (if applicable)
  • Analytics and crash reporting

Google Family Link: If you are a parent using Google Family Link, you can manage your child’s use of this Application through Family Link controls, subject to Google’s Family Link terms.

Refunds: Refund requests for the Application or in-app purchases should be directed to Google Play Store customer service in accordance with Google Play’s refund policy.

13. SUBSCRIPTION AND PAYMENT TERMS

If applicable to paid features or subscriptions:

  • All purchases are processed through Google Play Billing and subject to Google Play’s payment terms
  • Subscriptions automatically renew unless cancelled before the current period ends
  • You may manage subscriptions and cancel auto-renewal through your Google Play account settings
  • No refunds are provided for unused portions of subscription periods, except as required by law or Google Play policy
  • Prices may change with notice as permitted by applicable law

14. DISCLAIMER OF WARRANTIES

UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY PRODUCTION READY, THE APPLICATION IS PROVIDED “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PRODUCTION READY MAKES NO WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, OR CONTENT OF THE APPLICATION AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR THE SAME. PRODUCTION READY MAKES NO WARRANTIES THAT THE OPERATION OF THE APPLICATION WILL BE SECURE, ERROR-FREE, OR FREE FROM INTERRUPTION.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

15. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL PRODUCTION READY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES RESULTING FROM:

  • Use or inability to use the Application
  • Any data loss or corruption
  • Unauthorized access to your information
  • Interruption of business or services
  • Any other matter relating to the Application

IN NO EVENT SHALL PRODUCTION READY’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION. IF THE APPLICATION WAS PROVIDED FREE OF CHARGE, PRODUCTION READY’S LIABILITY SHALL NOT EXCEED $50.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR PERSONAL INJURY OR CERTAIN INTENTIONAL ACTS, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Production Ready and its officers, directors, employees, and agents from and against any claims, demands, costs, expenses, losses, liabilities, and damages arising from:

  • Your use of the Application
  • Your violation of this Agreement
  • Your violation of any third-party rights
  • Any content you create or transmit through the Application

17. ACCESSIBILITY AND NON-DISCRIMINATION

Production Ready is committed to making the Application accessible to users with disabilities. We strive to comply with applicable accessibility standards including the Web Content Accessibility Guidelines (WCAG) and Android accessibility best practices.

This Application and our services are available to all users regardless of race, color, religion, sex, sexual orientation, gender identity, national origin, disability, or age, in accordance with applicable civil rights laws.

18. EXPORT COMPLIANCE

You acknowledge that the Application and related technology are subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export restrictions and will not export, re-export, or transfer the Application to any prohibited country, entity, or person.

19. TERMINATION

This Agreement is effective until terminated. You may terminate it by uninstalling the Application and ceasing all use. Production Ready may terminate your access immediately if you violate any terms of this Agreement.

Upon termination, you must cease all use of the Application and delete all copies from your devices. Provisions that by their nature should survive termination will continue in effect.

20. GOVERNING LAW AND DISPUTES

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved exclusively in the federal or state courts located in San Francisco, California.

For EU Users: If you are a consumer residing in the European Union, you may have additional rights under local consumer protection laws that cannot be waived by this Agreement.

For Users in Other Jurisdictions: Local laws may provide additional consumer protections that cannot be waived by this Agreement.

21. MISCELLANEOUS

Entire Agreement: This Agreement constitutes the entire agreement between you and Production Ready regarding the Application.

Severability: If any provision is found unenforceable, the remainder of this Agreement will remain in effect.

No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not assign this Agreement without our written consent. Production Ready may assign this Agreement without restriction.

Force Majeure: Production Ready is not liable for delays or failures due to circumstances beyond our reasonable control.

Language: This Agreement is written in English. Any translations are provided for convenience only, and the English version shall prevail in case of conflicts.
